Types of neck injuries

Whiplash is an injury to the soft tissue in your neck. If your head moves unexpectedly and abruptly, it can cause the soft tissue in your neck to strain, leading to whiplash.

The most common cause of whiplash neck injuries is a road traffic accidents, but this isn't always the case. Your whiplash may have been the result of a sports accident or a slip or fall, for example.

Sometimes, the pain of a whiplash injury can take time to develop, so you may feel fine immediately following an accident, only to begin suffering neck pain at a later date.

Fracture to the vertebrae

Another type of neck injury is a fracture on your vertebrae.  

This could have been caused by a sudden impact during a road traffic accident, or by any form of movement that caused your neck to move abruptly.

How is my compensation is calculated?

Your compensation is calculated according  to the severity of your injury and how it has affected your daily life.

  • Any additional spend, such as travel or medical expenses
  • Any care you may have received, even if it was from a relative

Who pays my compensation?

The party responsible for your accident will be required to pay your compensation. The responsible party will vary, depending on the type of accident that caused your neck injury.

If a road accident caused your neck injury then your compensation will be paid by the other party’s insurance company.

If the driver cannot be traced or is uninsured, then the Motor Insurers’ Bureau will cover the costs of your compensation.

If you were injured in a public place, the person responsible for the public space will be responsible for paying your compensation. This could be the supermarket owner or Highways Agency, depending on where your accident happened. You can read more about public injury claims here

If you were injured at work, then your employer’s insurance will cover the cost of your compensation.

If your employer is responsible, you don’t need to worry about being treated any differently because you have made a claim - this would be illegal.

You also shouldn’t worry about the financial impact this might have on your employer as, by law, they are required to have insurance to cover the cost of your claim.
