Are there any time limits when making a falling object injury compensation claim?

You generally have three years from the date of your injury to either settle a falling object claim or start court proceedings. This is known as the limitation period. There are some exceptions to this three-year rule:

  • Claiming on behalf of someone under 18: You can claim at any point before their 18th birthday, after which they have until age 21 to either settle their claim or start court proceedings.
  • Mental capacity: No time limit applies, though this is assessed on a case-by-case basis. If they regain capacity at any point after the accident, even briefly, the standard three-year deadline to settle their claim or start proceedings begins from that date.
  • Fatal claims: Unfortunately, moving objects are the third biggest cause of fatal accidents for workers. If you're claiming on behalf of a loved one, you have three years from the date of their passing, within which the claim must be resolved, or legal proceedings must have started.
